Virginia’s McDonnell Reverses Gay Protections

Virginia’s new Republican governor, Bob McDonnell, reversed his predecessor’s order prohibiting discrimination on the basis of sexual orientation. It happened twelve days ago but no one apparently noticed until TPM’s Christina Bellantoni broke the story:

Gay and lesbian state workers in Virginia are no longer specifically protected against discrimination, thanks to a little-noticed change made by new Gov. Bob McDonnell.

McDonnell (R) on Feb. 5 signed an executive order that prohibits discrimination “on the basis of race, sex, color, national origin, religion, age, political affiliation, or against otherwise qualified persons with disabilities,” as well as veterans. It rescinds the order that Gov. Tim Kaine signed Jan. 14, 2006 as one of his first actions. After promising a “fair and inclusive” administration in his inaugural address, Kaine (D) added veterans to the non-discrimination policy – and sexual orientation.

In another development, the Washington Post reported that a measure passed the Democratic-controlled state Senate that would protect state workers from discrimination due to sexual orientation and gender identity or expression. The bill is all-but-certain to fail in the Republican-controlled House of Delegates.

Not a particularly surprising development. McDonnell is an unabashed evangelical and social conservative and Virginia is, outside the DC suburbs where I live, a staunchly conservative state.

Further, McDonnell’s office issued a statement saying, “It shall be the policy of the office of the Governor to ensure equal opportunity in the workplace, encourage excellence by rewarding achievement based on merit, and prohibit discrimination for any reason. Hiring, promotion, discipline and termination of employees shall be based on qualifications, performance and results.” One presumes that will in fact be the case.

Indeed, it’s difficult to see how the state government could win a suit in which there was blatant discrimination on the basis of sexual orientation regardless of the state of this executive order. My sense, then, is that this is a sop to the base with no meaning. It’s interesting, though, that this was done with so little fanfare that we’re just now hearing about it.

Virginia, the state that's supposedly "for lovers" seems to be squarely in the business of hate these days. The article says that it's "no surprise" that this would happen with a staunchly conservative evangelical dickhead like McDonnell, but I'm certainly surprised.

I'm surprised that, in this day and age, he's been allowed to get away with it. Nobody objected? Nobody protested? Nobody fucking screamed FOUL?! Sure, the article states that this is just a "for show" move and probably has no real power, but that's the author's opinion and he's dead fucking wrong. No lawsuit would win because any employer who fires someone for being gay is not breaking the law! You can't sue someone for doing something that's perfectly legal! Well, you CAN, but it would have to be taken all the way to the Virginia Supreme Court and they would have to overturn the law. That's something that I certainly hope to see happen, but until then the gay lovers in Virginia are fucked. An employer can ask them their sexual orientation, investigate their sexual orientation, etc. and then fire them based on their findings. Hell, job postings could even say "Homosexuals Need Not Apply."

This IS a big fucking deal! And where, might I ask, is the fucking mainstream media? I mean, sure, it's been on a few political talk shows, but what about the New York Times? The Washington Post? CNN? Searching for a news article to put in this rant, all I found were goddamn blogs. The one I settled on is only a step above a blog. WHERE IS THE FUCKING OUTRAGE?! Where is this "liberal media" that I keep hearing about; shouldn't they be up in arms over this?! Apparently, they're too busy hiding under their goddamn desks being fucking cowards and leaving the REAL reporting to online bloggers. Pussies! Maybe I should re-think my policy of only using "legitimate" news sources in rants. I mean, obviously the mainstream media is too busy choking on dicks to be half as effective as the bloggers are. Ironic, considering that we're talking about the rights of literal cocksuckers. Let's do a comparison!


Undoubtedly, someone will e-mail me a link to this news story on a "big media" website. And I won't fucking care. I didn't see it. It was never on the front page of anything, it was never on the news, it was barely mentioned by ANYONE. Sure, some big media corporation probably threw it up on page 28B or at the bottom of their webpage after you click "More headlines..." No, they're too goddamn worried about Tiger Woods' fucking apology to care that the rights of millions of people are being walked all over! The article above did mention the Washington Post reporting on this, so yeah, somebody DID cover it. The media has a talent for doing that; covering something *just* enough to say they didn't ignore it completely, while still ignoring it almost completely.

And speaking of which, what did the article say was reported in the Washington Post? That the Democratic controlled Virginia Senate PASSED this shit?! Democrats really are goddamn fucking pussies now, aren't they? After 8 years being dick-whipped by Bush, I'm afraid their spines are completely eroded now - and their brains! They seem to've forgotten that they're supposed to be the ones OPPOSING stupid religitarded bullshit like this! People vote Democrats into office when they DON'T want these things to happen!

It just continues to amaze me. Day after day, we hear all this talk of America being the greatest country in the world and how we're so "free." Yet still, even in this "great country" men and women can be told to go fuck themselves because they're gay. In the midst of all this "freedom" an American citizen can be told that they no longer have a job because of who they fuck.

That isn't freedom, and America ISN'T great. As long as some Americans are allowed to treat some other Americans like complete shit over things that hurt no one, there is no greatness in this country. Considering the fact that, in every generation, we keep finding new dirty little things that Americans are bigoted douchebags about, I honestly don't know if there ever was any greatness here to begin with.

To all those who might e-mail me saying "We're better than most other places when it comes to gays! At least we don't kill them like Uganda!" Well, that's true. Being a gigantic fucking asshole is better than being a murderer. So, congratulations for only being a gigantic fucking asshole, America! We're better than those other countries, so that means it's totally OK to still be huge douchebags! Hope you're proud...

Virginia AG orders colleges to stop protecting gays

Officials and student leaders at Virginia colleges are reacting mutedly, so far, to an order from state Attorney General Ken Cuccinelli that the schools stop protecting LGBT students.

In a letter (PDF) sent to the state's public colleges and universities and obtained by the Washington Post, Cuccinelli declared that the schools don't have the authority to uphold bans on discrimination on the basis of sexual orientation when the state itself has no such ban.

"It is my advice that the law and public policy of the Commonwealth of Virginia prohibit a college or university from including 'sexual orientation,' 'gender identity,' 'gender expression,' or like classification, as a protected class within its non-discrimination policy, absent specific authorization from the General Assembly," the letter stated.

Virginia Governor Bob McDonnell last month reversed an eight-year-old executive order that banned discrimination on the basis of sexual orientation in Virginia. The governor argued that only the state's General Assembly had the power to institute such a policy in the first place.

A bill to ban discrimination against gays was introduced in Virginia's legislature this year, but a Republican-led state House committee killed the bill this week.

The Washington Post reports that the state's public colleges and universities aren't jumping at the opportunity to rid themselves of a ban on anti-gay discrimination. So far, the College of William and Mary, Longwood University and Virginia Tech have all not responded to the attorney-general's request.

A Virginia Tech spokesman told the Roanoke Times that school officials would have to "confer" about the attorney general's assertion, and insisted the school's discrimination policy could only be changed by a decision of the board of visitors.

Carl Pucci, student body president at Old Dominion University, told the Post's Rosalind Helderman that the move won't be welcomed by today's post-secondary students.

"It's going to be a mess. There's no doubt about that," he said. "Our generation is really open-minded. The concept of discrimination, we're just not interested in that ... I think you're going to see the whole gamut, from angry letters to protests."

Virginia Democratic congressional candidate Rich Anthony held nothing back in his reaction to the news, calling the move "homophobic bigotry."

"Virginia’s Attorney General is actually trying to make it easier for people to discriminate against gays and lesbians in Virginia," he wrote on his blog. "This, despite the fact that the entire country is moving towards granting our GLBT fellow citizens equal rights with everyone else in all areas."

Anthony added, "I strongly condemn the ever increasing message of intolerance coming from the Republican leadership in Richmond. I encourage them to reconsider their recent actions that have not only harmed our fellow Virginians but also tarnished our beloved Commonwealth’s image."

When the goddamn south is looking progressive and evolved compared to you, there's a definite problem somewhere. I suspect that Virginians will be tired of being made to look like intolerant hillbillies once the next election rolls around. We can probably look forward to a new Governor and Attorney General in VA. Or, if not, at least then we'll know that Virginians, as a majority, are dumbass ignorant fucks.

Virginia's gay marriage ban has now been ruled unconstitutional. I just wanted to update this rant to say: HAHA, VIRGINIA! SUCK IT, BITCHES!
